Prosecuting, State Attorney Haruna Shomari told the court during hearing that the offence was committed on December 10, 2015 at around noon.
He told the court that the accused waylaid the Standard Two pupil as she was coming from school. The prosecution called five witnesses while the accused, Francis Dioniz (25), a resident of Kyabaile Village, in Misenyi District, called four witnesses.
In mitigation, Dioniz raised the defence of alibi praying for leniency saying that he was deceived by the devil to commit the offence.
Before passing the sentence, Magistrate Charles Oisso noted that the evidence proved beyond doubt that there was no other offender but the accused. He denounced the behaviour of the accused taking into consideration that the girl was medically examined and was found to have contracted HIV.
